Terms & Conditions for Registration of Marketing Officer (Commission-Based)
Preamble:
DPKHRC Trust’s unit, DBMS Online, is a cloud-based accounting software provider platform that offers accounting and auditing services to various firms, institutions, companies, and organizations. DBMS Online seeks to appoint Marketing Officers (commission-based) to promote and sell its software. Applications for the Marketing Officer position will be accepted online through the official website (www.dbmsonline.in). The following terms and conditions apply to the application process and collaboration. Please read and accept them carefully.
1. Eligibility
- 1.1. The applicant must be at least 18 years of age and a lawful, non-convicted citizen of India or any country worldwide.
- 1.2. The applicant must have experience or interest in sales, marketing, or related fields. Prior experience is not mandatory but may be preferred.
- 1.3. The applicant must possess basic computer and internet knowledge to understand and promote the features of DBMS Online accounting software.
- 1.4. The applicant must provide accurate and complete information during the registration process, including name, contact details, educational qualifications, identification documents (e.g., Aadhaar card), and other required documents.
2. Registration Process
- 2.1. Applications for registration will only be accepted online through DBMS Online’s official website (www.dbmsonline.in).
- 2.2. The applicant must upload all requested information and documents (e.g., identification documents, resume, etc.) in the online registration form.
- 2.3. DBMS Online will review the applications and, at its sole discretion, may accept or reject them.
- 2.4. Approved applicants will be notified via email or phone, and a formal Marketing Officer agreement will be signed with them.
- 2.5. No fee will be charged for online registration unless explicitly stated otherwise.
3. Responsibilities of the Marketing Officer
- 3.1. Promote DBMS Online accounting software to potential clients such as firms, institutions, companies, organizations, and NGOs.
- 3.2. Encourage clients to purchase DBMS Online software and assist during the sales process.
- 3.3. Use only authorized marketing materials provided by DBMS Online.
- 3.4. Provide regular activity and sales reports as specified in the agreement.
- 3.5. Maintain ethical conduct and uphold DBMS Online’s brand reputation.
4. Responsibilities of DBMS Online
- 4.1. Provide training, marketing materials, and technical support.
- 4.2. Pay agreed commissions for successful sales.
- 4.3. Ensure transparency in commission calculation and payments.
5. Commission Structure
- 5.1. Fixed commission will be paid for each successful sale as per agreement.
- 5.2. Commission rates may vary based on software package and updates.
- 5.3. Payments will be made through bank transfer or UPI after successful receipt of client payment.
- 5.4. Applicable taxes (including TDS) will be deducted as per Indian tax laws.
6. Confidentiality and Data Security
- 6.1. All client data, strategies, and software details must remain confidential.
- 6.2. Information must not be shared with third parties.
- 6.3. DBMS Online will protect personal data using appropriate technical safeguards.
- 6.4. Confidentiality obligations survive termination.
7. Agreement and Termination
- 7.1. A formal agreement will be executed after approval.
- 7.2. Either party may terminate with one month’s prior written notice.
- 7.3. Immediate termination may occur for violations or unethical conduct.
- 7.4. Pending commissions will be paid for completed sales.
8. Independent Contractor
- 8.1. This is not an employer-employee relationship.
- 8.2. The Marketing Officer bears all expenses and tax responsibilities.
9. Indemnification
- 9.1. The Marketing Officer indemnifies DBMS Online for misconduct or negligence.
- 9.2. DBMS Online indemnifies the Marketing Officer for incorrect software information.
10. Dispute Resolution
- 10.1. Disputes will be resolved through mutual negotiation.
- 10.2. Unresolved disputes may proceed to mediation or court jurisdiction.
11. Amendments
- 11.1. DBMS Online may amend these terms at any time.
- 11.2. Continued collaboration implies acceptance of changes.
12. Legal Compliance
- 12.1. All activities must comply with applicable Indian laws.
- 12.2. Marketing must follow consumer protection and advertising standards.
